Terms of Service – Whakapakari Ora

Nau mai, haere mai. Welcome to Whakapakari Ora Tāpui Ltd.
These Terms of Service govern your engagement with our website, products, services, workshops, and clinics. By booking or participating in our services, or by purchasing our products, you agree to these terms. If you do not accept these terms, please refrain from using our services or website.


1. Use of Our Website and Services

1.1 You must be 18 years or older to make bookings or purchases, unless accompanied by a parent or guardian.
1.2 You agree to provide accurate, current, and complete information when booking services or purchasing products.
1.3 You are responsible for keeping your account details secure and for all activity under your login or email.
1.4 You agree not to use our services or website for any unlawful or unauthorised purposes, including (but not limited to) violating applicable laws, tikanga, or community standards.
1.5 Participation in wānanga, clinics, and wellness sessions requires you to follow all health, safety, and tikanga guidelines provided by Whakapakari Ora.


2. Scope of Practice and Disclaimer

2.1 Whakapakari Ora delivers holistic Māori wellness services, including rongoā Māori, mirimiri, raranga, wānanga, corporate wellbeing, and health coaching.
2.2 These services are complementary and are not a substitute for medical diagnosis or treatment. We encourage you to continue care with your medical providers.
2.3 All internal rongoā (teas, tinctures) are offered with informed consent, and ingredients will be disclosed. External rongoā (balms, oils) will be patch tested where relevant.
2.4 You are responsible for informing us of any allergies, health conditions, injuries, or sensitivities prior to your session or product purchase.
2.5 Whakapakari Ora practitioners work within their scope of training and will refer you to other providers if your needs are beyond our expertise.


3. Product and Service Information

3.1 We aim to provide accurate, up-to-date information about our offerings, but we do not guarantee descriptions, availability, or service details are error-free.
3.2 All rongoā products comply with the Medicines Act 1981, Therapeutic Products Bill, and relevant labelling standards. We make no unverified health claims.
3.3 We may update, modify, or discontinue any product, service, or pricing at any time without prior notice.


4. Pricing and Payment

4.1 All prices are listed in New Zealand Dollars (NZD) and include GST unless otherwise stated.
4.2 Prices are confirmed at the time of booking or purchase.
4.3 Payments must be made via our approved secure payment methods.
4.4 For workshops or wānanga, payment terms (including deposits and cancellations) will be provided at the time of booking.


5. Cancellations and Refunds

5.1 Cancellation policies for workshops, wānanga, and corporate packages will be stated at the time of booking.
5.2 Refunds will be provided in line with the Consumer Guarantees Act 1993.
5.3 We reserve the right to reschedule or cancel an event due to unforeseen circumstances (e.g. illness, extreme weather, maramataka alignment, or emergencies). If this occurs, you will be offered a refund or transfer to a future date.


6. Privacy and Data Protection

6.1 We comply with the Privacy Act 2020 and the Health Information Privacy Code.
6.2 Client information is stored securely in our patient record management system with restricted access.
6.3 We will not share your personal information without your consent unless required by law.
6.4 You have the right to request access to, and correction of, your personal data at any time.


7. Health, Safety, and Tikanga Obligations

7.1 You agree to follow any safety protocols provided by our kaimahi (staff) during sessions, including cultural safety guidelines such as karakia, harvesting etiquette, and respectful engagement.
7.2 Whakapakari Ora operates in compliance with the Health and Safety at Work Act 2015 and the Health and Disability Services Standards.
7.3 We reserve the right to refuse service if safety, wellbeing, or tikanga standards cannot be upheld.


8. Intellectual Property and Mātauranga Māori

8.1 All content, teaching materials, designs, and product recipes provided by Whakapakari Ora remain the intellectual property of our practitioners and are protected under copyright law.
8.2 Cultural knowledge shared during sessions is part of the mātauranga Māori system and must be used respectfully.
8.3 You may not reproduce, record, or distribute any teaching materials or session content without written consent.


9. Limitation of Liability

9.1 To the maximum extent permitted by law, Whakapakari Ora is not liable for any indirect or consequential loss, injury, or damage arising from the use of our services or products.
9.2 Our total liability for any claim will not exceed the amount paid for the specific service or product.


10. Changes to Terms

We may update these Terms of Service from time to time. The latest version will always be available on our website.
